Terms of Use
Acceptance of terms
These Terms of Use govern your access to and use of the iShootNYC website, including public portfolio and project pages, the Contact form, and authorized delivery or access to content where applicable. By using the site, you agree to these Terms. If you do not agree, do not use the site.
“iShootNYC,” “we,” “us,” and “our” mean iShootNYC.
About the site
The site presents photography, video, and production portfolio content; information about services and projects; Contact inquiry functionality; and authorized delivery or access to content where applicable.
The current site does not offer public ecommerce, online payment processing, subscriptions, refunds, or ordinary visitor accounts. Any production services, fees, schedules, deliverables, or usage rights are governed by a separate written agreement where applicable.
Intellectual property
The site’s design, code, text, branding, and media are owned by iShootNYC or used with permission from their respective owners. Portfolio photographs, videos, client material, project media, names, trademarks, and other content may be owned by iShootNYC, a client, a collaborator, or another rights holder.
Nothing in these Terms claims ownership of material that belongs to another party. You may not assume that content displayed on the site is free to reuse.
Permitted use
You may access and view public site content for personal, informational, and legitimate business-inquiry purposes. Authorized clients and recipients may access or use delivered content only for purposes allowed by the applicable contract, proposal, license, release, invoice terms, or other written permission.
Prohibited conduct
You may not copy, reproduce, publish, distribute, sell, license, scrape, harvest, frame, modify, create derivative works from, or commercially exploit site content except as expressly authorized.
You may not attempt to gain unauthorized access to restricted areas, resources, accounts, files, or systems; bypass security measures; evade rate limits; interfere with site operation; use bots or automated systems in a manner that burdens the service; submit malicious code; impersonate another person; misuse the Contact form; or misuse access credentials or links provided to you.
Downloads and licenses
Access to or download of a photograph, video, or other file does not transfer copyright or automatically grant permission for unrestricted use.
Usage rights are governed by the applicable contract, proposal, license, release, invoice terms, or other written permission between iShootNYC and the client. The website itself does not grant any additional rights to reproduce, publish, distribute, sublicense, sell, alter, or commercially use displayed or downloaded material.
Contact submissions
You agree to provide accurate information and to use the Contact form only for legitimate inquiries. Submitting an inquiry allows us to use the provided information to review and respond to it. A submission does not create a client relationship, reserve a date, establish a price, or obligate either party to enter an agreement.
Medical/Healthcare inquiries are for photography and production services only. Please do not submit patient-identifying information, medical records, or other sensitive health information. The site does not provide medical services or medical advice.
Third-party services and content
The site may use or link to services operated by Vercel, Supabase, Postmark, YouTube, Vimeo, Google Maps, and other external sites selected in published content. Third-party services are controlled by their operators. We are not responsible for their separate content, availability, security, or practices.
References to clients, collaborators, products, or third-party marks do not imply endorsement unless expressly stated.
Availability and changes
We may change, suspend, restrict, or discontinue any part of the site, content-delivery functionality, or content at any time. Authorized access or downloads may expire or become unavailable. We do not guarantee uninterrupted, error-free, or permanent access.
Disclaimer of warranties
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant that the site will always be available, secure, accurate, complete, or free of harmful components.
Nothing in this section limits obligations expressly stated in a separate signed client agreement.
Limitation of liability
To the fullest extent permitted by law, iShootNYC and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, business opportunities, or use arising from or related to the site.
Any liability that cannot lawfully be excluded will be limited to the minimum extent permitted by applicable law. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless iShootNYC and its owners, personnel, and contractors from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the site, violation of these Terms, misuse of restricted resources or delivered content, or infringement of another person’s rights.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Changes to these Terms
We may update these Terms when the site, services, or legal requirements change. Revised Terms will be posted on this page with an updated effective date. Continued use after an update constitutes acceptance to the extent permitted by law.
